As the original purchaser of the MakeAMom kit, at-home insemination products, or any other item sold directly to you by MakeAMom, you are entitled to certain legal rights under this limited warranty. Please note that you may also have additional rights that vary by state.
1. Limited Warranty
MakeAMom guarantees that each product will be delivered to you in a sealed package and in undamaged condition. For the duration specified on the product’s packaging (the “Warranty Term”), it will: (a) perform as described in the user instructions, and (b) be free from defects in materials and craftsmanship.
Your exclusive remedy for any product that fails to meet this warranty is, at MakeAMom’s discretion, either (i) a replacement of the product or (ii) a refund of your purchase price. To initiate a remedy, you must follow the claim procedures outlined in Section 2.
This warranty does not cover damage or issues resulting from alterations, tampering, misuse, or exposure to extreme conditions.
2. Claim Procedures
If you believe you are eligible for a remedy under this warranty, please contact MakeAMom before the Warranty Term expires. Ensure you provide proof of purchase, such as your receipt, and if possible, include the original packaging or photographs of the product. MakeAMom may request the return of the product following specific instructions provided.
3. Exclusions and Limitations
This warranty represents the only warranty offered by MakeAMom for its products, replacing all other warranties, whether express or implied. The remedies stated in Section 1 are your sole recourse regarding any claims related to MakeAMom and its products.
MakeAMom disclaims all other warranties to the extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. If your state does not allow for the exclusion of implied warranties, this limitation may not be applicable to you.
Furthermore, MakeAMom does not guarantee that the use of its products will lead to pregnancy. We are not liable for any consequential, incidental, special, or punitive damages, whether direct or indirect. Some states do not allow exclusions of incidental or consequential damages, so this limitation may not apply to you.
MakeAMom’s liability for any losses related to a product will be limited to the amount you paid for that product. All exclusions and limitations mentioned will apply even if any part of this warranty fails to fulfill its essential purpose.
4. Miscellaneous
This limited warranty does not apply to products purchased from unauthorized sellers. If a court or arbitrator with appropriate jurisdiction finds any term of this warranty unenforceable, the remaining terms will remain in effect.
